Argument In Favor Of 2008 BALLOT Measure _________________________________________

This initiative is the citizens’ solution to the city’s refusal to help control the numerous problems caused by transient home rentals in their neighborhoods. The number of transient rentals has exploded, creating an unreasonable and unmanageable burden to the residents. The city has also refused to equally enforce the law with respect to transient rentals and the rest of the lodging industry. Not only does this refusal promote unfair competition, but it exposes the city to potential liability for its lax health and safety policies.

This is a regulatory ordinance. It does NOT eliminate overnight rentals. It WILL improve the quality of transient rentals. It WILL provide immediate remedies for unruly and unlawful overnight uses. It WILL encourage currently unregistered rentals to become licensed. It WILL provide residents with notice of each proposed commercial use of a residence in their neighborhoods. It WILL give the residents a voice in the operation of the neighborhood rental.

A study commissioned by the City suggests adverse financial impacts to the City if the ordinance is approved. However, the study correctly points out that “further study may be required” and “impact in the long term is speculative and will depend on many factors, including how this Measure is enforced.” The study relies on flawed data, makes unreasonable and incomplete assumptions, and performs questionable analyses. If administered with common sense the ordinance could actually result in increased revenues through the licensing of the numerous transient rentals that currently operate illegally.

The ordinance reinforces the city’s obligation to apply existing Federal, State, and County laws to all segments of the lodging industry. It will provide residents and visitors with increased protections and it will enhance quality of life for residents and guests alike.
